Rayden Solicitors Partner Katherine Rayden and Associate Nicola Meldrum, with Deidre Fottrell QC Leading Counsel and Eleri Jones of 1 Garden Court, represented the father in the decision Re I-L (Children) (1996 Hague Child Protection Convention: Inherent Jurisdiction) in the successful appeal against the decision of Mr Charles Geekie QC, sitting as a Deputy High Court Judge to make an order under the inherent jurisdiction requiring the parties two children to be returned to Russia.
Rayden Solicitors have been involved in this case since May 2019 when proceedings in this country began. The decision made by the Court of Appeal highlights the difficulties in dealing with competing jurisdictions governing the care of children which further clarifies the extent to which Orders made under the inherent jurisdiction can be made following the recent decision in the Supreme Court, in the matter of NY.
