Resolution “Good Divorce Week”

26 to 30 November 2018 marks “Good Divorce Week”, a campaign spearheaded by Resolution.

Who are Resolution?

Resolution is a body of 6,500 family lawyers and other professionals which promotes a non-confrontational approach to family problems. It is committed to resolving family disputes constructively and seeks to provide solutions that limit the impact of relationship breakdown on the parties and particularly their children.

What is “Good Divorce Week”?

Good Divorce Week aims to provide practical help, highlighting ways for separating parents to put their children’s needs first, as well as calling on the government to urgently remove blame from the divorce process.

No Fault Divorce

Currently, the law provides that unless you have been separated for 2 years with consent, or 5 years without, you have to divorce on the grounds of adultery or behaviour. Unfortunately this means that, in 2016 the majority (60%) of divorces in England and Wales were granted on either adultery or behaviour (Finding Fault 2017).  This is despite the fact that a recent national opinion survey showed only 29% of respondents to a fault divorce said that the Fact used very closely matched the reason for the separation (Finding Fault, 2017).

Requiring parties to show fault can unnecessarily increase the conflict between the couple and make it more difficult to sort out child and financial arrangements. Rayden Solicitors strongly support Resolution’s campaign and consider that no fault divorce is urgently needed to reduce acrimony for separating couples and in particular protect the long-term interests of children.
